What Does It Mean to Be Charged with an Offence Under Section 5AA?

Under Section 5AA of the Control of Weapons Act 1990 (β€œCWA”), it is an offence to possess, use, or carry a prohibited weapon (other than an imitation firearm) without an exemption under Section 8B or an approval under Section 8C.

What Does the Prosecution Have to Prove?

To secure a conviction under Section 5AA of the CWA, the prosecution must establish the following elements:

    1. You possessed, used, or carried aΒ prohibited weaponΒ (excluding imitation firearms).
    2. The weapon in question is classified as a prohibited weapon according to Schedule 2 of the Control of Weapons Regulations 2021.

Penalties for Possessing, Using, or Carrying a Prohibited Weapon:

  • 240 penalty units or imprisonment for up to 2 years.

What Constitutes a Prohibited Weapon?

Prohibited weapons are items considered unsuitable for general possession or use without special approval. Examples include:

  • Flick knife
  • Daggers
  • Knuckle knife
  • Butterfly knife
  • An item designed to conceal a prohibited weapon

Distinguishing Controlled and Prohibited Weapons

Controlled weapons differ from prohibited weapons in that they can be possessed and used for legitimate purposes, though they may still pose a potential danger. Examples include:

  • Knives not classified as prohibited weapons
  • Spear guns
  • Batons or cudgels
  • Bayonets
  • Cattle prods
